1. Acceptance of Terms

By accessing or using My Signal Vault ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service. My Signal Vault reserves the right to modify these terms at any time, and continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

My Signal Vault is a digital deadman switch and encrypted cloud storage platform. The Service allows users to create time-triggered vaults that automatically deliver encrypted files and messages to designated recipients when a user fails to check in within a specified period. The Service includes file encryption, secure storage, timed delivery mechanisms, and subscription-based access tiers.

3. User Responsibilities

As a user of My Signal Vault, you are solely responsible for:

  • Maintaining the confidentiality and security of your account credentials, including your password and any multi-factor authentication codes.
  • Ensuring that all content uploaded, stored, or transmitted through the Service complies with applicable laws and regulations.
  • Verifying the accuracy of recipient email addresses and vault timer configurations.
  • Performing timely check-ins to prevent unintended vault triggers.
  • Maintaining backup copies of any files or data stored on the Service.
  • All activity that occurs under your account, whether or not authorized by you.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SIGNAL VAULT, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Service.
  • Any loss of data, revenue, profits, business opportunities, or goodwill, whether arising from contract, tort, negligence, strict liability, or any other legal theory.
  • Any unauthorized access to, alteration of, or destruction of your data, files, or transmissions.
  • Any failure, delay, or interruption of the Service, including but not limited to server downtime, scheduled or unscheduled maintenance, internet outages, or third-party service failures.
  • Any failure of vault triggers, email delivery, file encryption or decryption, or timed mechanisms to operate as expected.
  • Any damages resulting from third-party actions, including but not limited to email providers filtering, blocking, or routing messages to spam or junk folders.
  • Any loss or damage arising from self-destruct file operations, whether triggered automatically or manually.
  • Any actions taken by recipients who receive vault contents upon trigger.

IN NO EVENT SHALL SIGNAL VAULT'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO SIGNAL VAULT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. SIGNAL VAULT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6. Indemnification

You agree to indemnify, defend, and hold harmless My Signal Vault, its owners, operators, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you upload, store, or transmit through the Service.

7. Encryption and Security

My Signal Vault employs AES-256-GCM encryption to protect user files and data. While we implement industry-standard security measures, no method of electronic storage or transmission over the internet is 100% secure. My Signal Vault cannot guarantee absolute security and shall not be liable for any security breaches, unauthorized access, or data loss that may occur despite reasonable security precautions.

8. Account Termination

My Signal Vault reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the Profile settings. All data associated with a deleted account will be permanently removed and cannot be recovered.

9. Payment and Subscriptions

Paid subscription plans are billed through Stripe. All payments are non-refundable unless otherwise required by applicable law. Subscription cancellations take effect at the end of the current billing period. My Signal Vault reserves the right to modify pricing with reasonable notice to existing subscribers.

10. Prohibited Use

You agree not to use the Service to:

  • Upload, store, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Violate any applicable local, state, national, or international law or regulation.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to other user accounts or any computer systems or networks.
  • Use the Service for any form of harassment, stalking, or intimidation.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which My Signal Vault operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
